A Delhi court on Friday took cognisance of a complaint against Som Dutt, AAP MLA from Sadar Bazar, after BJP candidate Praveen Jain alleged that Dutt had filed incorrect information about his dependents in the affidavit while contesting Delhi Assembly elections of 2015.
Praveen Jain, based on an RTI filed through his counsel Vivek Garg, told the court that while Dutt had denied any dependent in his affidavit on one hand, he had also availed a medical facility card under Delhi Government Employees Health Scheme, where he mentioned his parents name in the dependent column.
“Aam Aadmi Party MLA Som Dutt in both his affidavits of 2013 and 2015 had declared his parents independent and therefore did not declare their assets and liabilities. After an RTI was filed it was revealed that that Dutt had managed to obtain a medical facility card disclosing his parents as dependents thus exposing the corrupt practice of the MLA. Only dependent parents can avail medical facility on the medical facility card of an MLA,” said Vivek Garg, counsel for Praveen Jain.
In the prayer, the complainant has asked the Delhi court to punish the accused under Sections 200, 199, 193, 181 and 177 of the Indian Penal Code and Section 125-A of Representation of People Act, 1951 as the accused represents the public and the crime is against the interest of the public at large. When contacted, AAP MLA Som Dutt told that he is unaware of the issue.
The next date for hearing is October 30. Since the Aam Aadmi Party came into power, several MLAs have come into the legal ambit for one or the other reason. Earlier, Bhavna Gaur and former Delhi law minister Jitender Singh Tomar created controversy due to similar incidents. Dutt did not file correct information about his dependents.
